1. Parties & Acceptance

These Terms and Conditions ("Terms") govern all tours, day trips, trekking, and activities booked with Extra Mile DMC, a licensed Moroccan travel company trading as Marrakech Desert Trips (License N° 16D/19), with registered offices at Bureau B3, Immeuble Riad Nawal G, Boulevard Mozdalifa, Marrakech 40000, Morocco ("we", "us", "MDT").

By making a booking, you ("the client") accept these Terms on behalf of yourself and all persons included in the booking. Please read them carefully before confirming your reservation.

2. Booking & Confirmation

A booking is confirmed once we receive your deposit payment and send you a written confirmation (email) with your itinerary, inclusions, and pricing. Until confirmation is sent, no booking exists.

We reserve the right to decline any booking at our discretion.

3. Deposits & Payment

Deposit

Deposits are paid online via credit card, debit card, or PayPal/Stripe.

Remaining Balance

The remaining balance must be paid to our staff on the day of departure, before the tour begins. We use xe.com rates as the currency conversion base.

4. Cancellation Policy

Cancellations must be communicated to us in writing (email or WhatsApp). The cancellation terms depend on the tour type and notice period:

Where the deposit is retained due to late cancellation, it may be used as credit towards a future booking within 12 months of the original tour date.

5. Changes to Your Booking

We will do our best to accommodate changes to dates, hotels, or itineraries at no extra charge. Changes requested less than 15 days before departure may not be feasible due to supplier availability. If we cannot accommodate your change, you may proceed with the original booking or cancel per the cancellation terms above.

Date changes are free of charge when made more than 7 days before departure, subject to availability.

6. Inclusions & Exclusions

Each tour has specific inclusions listed on its booking page and in your confirmation email. As a general guide:

Typically Included

• Hotel pickup and drop-off in Marrakech
• Transport in air-conditioned vehicle
• Accommodation (on multi-day tours) with dinner and breakfast
• Sunset camel ride (on desert tours)
• Stops at listed attractions and viewpoints

Typically NOT Included

• Lunch (budget ~40–60 MAD per meal)
• Entrance fees to attractions (unless specified)
• Tips for drivers, guides, and camp staff
• Travel insurance
• Personal expenses and souvenirs

Your confirmation email is the definitive list of inclusions for your specific booking.

7. Children & Family Policy

Child Pricing

8. Force Majeure & Tour Cancellation by MDT

We reserve the right to cancel or modify a tour due to circumstances beyond our control, including but not limited to: natural disasters, severe weather, road closures, government restrictions, civil unrest, pandemics, or any event that makes the tour unsafe or impractical.

If we cancel your tour, you will receive a full refund of all payments made (including deposit). We are not liable for additional compensation, including but not limited to airfare, accommodation, or consequential losses.

9. Travel Insurance

We do not provide travel insurance. It is your responsibility to obtain adequate travel insurance covering medical expenses, trip cancellation, personal belongings, and repatriation. We strongly recommend comprehensive cover, especially for desert and mountain activities.

We are not liable for costs arising from illness, injury, lost baggage, delays, or other events that would normally be covered by travel insurance.

10. Special Requests

Special requirements (dietary needs, medical conditions, mobility assistance, or accommodation preferences) must be communicated to us in writing before booking. We will pass these to our supplier partners and confirm what can be accommodated. If we cannot meet a special request, we will advise you before you confirm your booking.

We will make every reasonable effort but cannot guarantee fulfilment of preferences (e.g., bed configuration, room location, specific vehicle type). No compensation is payable for unmet preferences.

11. Travel Documents & Visa

It is your sole responsibility to ensure you have valid travel documents. Your passport must be valid for at least 6 months from the date of entry into Morocco. Citizens of the EU, UK, US, Canada, Australia, and 60+ countries receive visa-free entry for 90 days — check with your nearest Moroccan consulate if unsure.

We are not liable for any costs or consequences arising from invalid or insufficient travel documents.

12. Liability

We accept responsibility for the services described in your booking confirmation, provided they are directly supplied by us or our contracted partners. Our total liability shall not exceed the total amount paid for the affected tour or service.

We are not liable for:

• Death, personal injury, illness, or property damage unless caused by our negligence
• Acts or omissions of third parties not contracted by us
• Events beyond our control (see Force Majeure, Section 8)
• Your failure to follow safety instructions from guides, drivers, or camp staff
• Loss or damage to personal belongings, including luggage left in vehicles

Adventure activities (camel riding, trekking, quad biking) carry inherent risk. By participating, you acknowledge and accept these risks. We recommend travel insurance that covers adventure activities.

13. Photography & Content

During tours, our drivers or guides may take photographs that could include you or members of your group. By booking, you grant us permission to use such photographs for marketing, social media, and website content, unless you inform us in writing before or during the tour that you do not wish to be photographed.

14. Complaints

If you experience any issue during your tour, please notify your driver, guide, or accommodation provider immediately so we can attempt to resolve it on the spot. If the issue cannot be resolved locally, contact us:

Written complaints must be submitted within 30 days of the tour end date. We will acknowledge receipt within 48 hours and aim to resolve complaints within 14 working days.

15. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Kingdom of Morocco, including the Dahir des Obligations et Contrats (Moroccan Code of Obligations and Contracts). Any disputes arising from these Terms or your booking shall be subject to the exclusive jurisdiction of the courts of Marrakech, Morocco.

16. Modifications

We reserve the right to update these Terms at any time. Changes take effect immediately upon publication on this page. Continued use of our services after changes constitutes acceptance of the revised Terms. The Terms in effect at the time of your booking apply to that booking.
